Terms of Service

Welcome to Chudong. These Terms of Service ("Terms") are a binding agreement between you and Chudong ("we", "us", or "our") and govern your access to and use of the Chudong website, applications, and software (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, Refund Policy, and Acceptable Use Policy.

1. The Service

Chudong is AI assistant software for live streaming. It provides tools such as real-time captions and translation, an AI avatar co-host, smart chat replies, AI-generated topics and scripts, automatic highlight clips, multi-platform simulcast, and analytics. The Service is a software product; we do not host a streaming marketplace, and we do not sell virtual currency or virtual gifts.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.

3. Your account

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately at mihailradkevic2@gmail.com of any unauthorized use. You may not share, resell, or transfer your account or seats except as expressly permitted by your plan.

4. License

Subject to these Terms and your active plan, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own streaming activities. You may not copy, modify, reverse engineer, resell, or create derivative works of the Service, or use it to build a competing product.

5. Subscriptions, billing & renewals

• Paid plans are offered as recurring subscriptions billed monthly or yearly through our payment processor, Stripe. Prices are shown in US dollars (USD) and may exclude applicable taxes.
• By subscribing, you authorize us (via Stripe) to charge your payment method automatically at the start of each billing period until you cancel.
• You can cancel at any time from your account settings. Cancellation stops future renewals; your plan remains active until the end of the current paid period.
• We may change plan features or pricing; we will give reasonable notice of price changes that affect your renewal, and changes apply only to subsequent billing periods.
• You are responsible for keeping your payment method valid. Failed payments may result in suspension of paid features.

6. Free plan & trials

We may offer a free plan or free trial with limited features or usage. We may modify or discontinue free offerings at any time. If a trial converts to a paid plan, the applicable subscription terms apply.

7. Refunds

Refunds are handled as described in our Refund & Cancellation Policy, which includes a 7-day money-back guarantee on new paid subscriptions. Please review it before purchasing.

8. Acceptable use

You agree to use the Service lawfully and in line with our Acceptable Use Policy. You must not use the Service to create, stream, or distribute illegal content, sexually explicit material, content that exploits minors, harassment, hate speech, malware, or to infringe others' rights, or to violate any platform's own rules. You are responsible for your streams and content.

9. AI features

The Service uses AI to generate captions, translations, replies, scripts, and clips. AI output may contain errors or inaccuracies and is provided "as is" for assistance only. You are responsible for reviewing AI-generated content before relying on or publishing it. AI co-host and AI replies are clearly identifiable as automated.

10. Your content

You retain all rights to the streams, audio, video, and other content you process with the Service ("Your Content"). You grant us a limited license to process Your Content solely to provide the Service to you (for example, to generate captions or clips). We do not claim ownership of Your Content and do not sell it.

11. Intellectual property

The Service, including its software, models, design, and trademarks (excluding Your Content), is owned by Chudong or its licensors and protected by law. All rights not expressly granted are reserved.

12. Suspension & termination

We may suspend or terminate your access if you violate these Terms or the Acceptable Use Policy, fail to pay, or to protect the Service or others. You may stop using the Service at any time. Sections that by their nature should survive termination (e.g., payment owed, disclaimers, liability limits) will survive.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate.

14. Limitation of liability

To the maximum extent permitted by law, Chudong will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three (3) months before the event giving rise to the claim.

15. Changes

We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date and, where appropriate, provide additional notice. Continued use after changes take effect constitutes acceptance.

16. Governing law

These Terms are governed by the laws applicable in the operator's place of business, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your country apply.
